Forty years after its formation, the regime established by the International Convention on the Settlement of Investment Disputes (ICSID) is thriving. ICSID's new prominence however has come at a price. Faced with sharply increasing numbers of investment claims, arbitral tribunals have been forced to re-think old, and confront new, problems.
