The law of sedition and criminal libel has always been a source of controversy. This is because the law seeks to curb totalitarianism to a culture of human rights. The position and context shall be that of Kenya comparing both the pre-2010 and post 2010 regimes with the positions in other states in the commonwealth. It seeks to establish a standing position and possible recommendations. In the end, what is necessary is that there is a balance between the competing need to ensure reputation is safeguarded and the overriding objective to ensure that the right to freedom of expression is protected.
